Developer seeks waiver for building to exceed height limit

PROVIDENCE – A developer who wants to build an 11-story building over a parking lot on Canal Street downtown has requested several waivers from the city’s new zoning ordinance, including one that would allow the building to exceed the height limit.
A public hearing on the project at 169 Canal St. will be held by the Downtown Design Review Committee at some point in the next few months. At the request of the applicant, a hearing scheduled for Aug. 15 is expected to be continued. The project is sought by applicant MSI Holdings LLC. The registered agent for the company is David C. Tapalian.
The proposed structure will have a mix of retail and residential apartments and will require waivers from development and design standards in the city’s new downtown zoning ordinance. The applicant has requested waivers from the recess requirement, and ground floor and upper level transparency requirements for the portion of the building that faces a narrow alley, called Throop Street.
A revised design that added a floor to the building will also bring it 7 feet over the height restriction for the district, according to Chris Ise, a city planner.
All of the issues can be accommodated through waivers.
The project architect is Jo Ann Bentley Architects Inc. of Fall River.
