Kilmartin sues fire district under APRA

PROVIDENCE – The R.I. Office of Attorney General this month filed a complaint in R.I. Superior Court citing the Nasonville Fire District for violations of the R.I. Access to Public Records Act for failure to respond to a request within the time as prescribed by law.
On Jan. 15, 2014, the International Association of Fire Fighters Local 4968 made an APRA request to the Nasonville Fire District in Burillville seeking various tapes and minutes of the fire district’s meetings. The district failed to respond to the APRA request within 10 business days.
The association filed a complaint with the Office of Attorney General on April 14, 2014. After an investigation, Attorney General Peter F. Kilmartin’s office issued a finding on Sept. 22, 2014, that the district was in violation the APRA.
By a supplemental finding dated Jan. 8, 2015, the Office of Attorney General concluded that the APRA violation was “willful and knowing or reckless” and notified the fire district of the intent to file a civil lawsuit in Rhode Island Superior Court.
The maximum penalty under the APRA is $2,000 for knowing and willful violations and $1,000 for reckless violations. •
