NEW YORK – The United States Court of Appeals for the Second Circuit has denied New England Patriots quarterback Tom Brady’s appeal of an earlier ruling that reinstated his four-game suspension over the Deflategate incident. The denial leaves the four-time Super Bowl winner with only the U.S. Supreme Court left as a venue to have an appeal heard, according to The New York Times.
The Times noted that with the beginning of the season only two months away, it is likely that Brady will not be able to get an appeal heard by the nation’s highest court, thus leaving him to miss the team’s first four games, returning to play the Cleveland Browns in October.
The suspension is based on a determination by the NFL that footballs the Patriots used in its Jan. 18, 2015, win over the Indianapolis Colts in the AFC championship game we underinflated, and that Brady had knowledge of a plot to do so. He has denied any such knowledge.
A suit by Patriots’ fan against the NFL over the suspension was recently thrown out.
