Conn. sues CVS over expired products
WOONSOCEKT – Connecticut’s attorney general is suing CVS Caremark Corp. for failing to remove expired products from its store shelves, less than a month after the company agreed to pay $875,000 to settle a similar suit in New York.
In a statement, Attorney General Richard Blumenthal said an investigation by his office found expired products – including baby formula, medicines and dairy products – in at least 20 of 45 stores checked around the state, Bloomberg News reported.
“Shockingly, our 2009 investigation showed nearly one of every two CVS stores surveyed selling out-of-date food and over-the-counter medicine,” Blumenthal said. “The out-of-date rate – double last year – seems definitely worsening.”
A spokesperson for CVS was not immediately available for comment.
On Nov. 10, CVS agreed to pay $875,000 to settle a lawsuit brought by N.Y. Attorney General Andrew Cuomo after Cuomo’s office said it found an “egregious pattern” of selling expired products at CVS/pharmacy and Rite Aid Corp. stores. Rite Aid settled for $1.3 million last December.
CVS also settled an expired-products suit with California in June by agreeing to give a $2 coupon to customers who find expired products at its stores.
